摘要
推动党内法规制度建设是党内治理法治化的必然要求。一整套严密的党内法规体系可有效应对科层化必然促发的先进性与代表性危机,在“党—群”与“党—政”两个基础关系维度确保党的人民性。欲达此目的,党内法规制度建设需要平衡法治化思维与政治性取向之间的张力:在制度框架建构的表层,需要依循国法思维完善党内法规;在制度导向设定的深层,依规治党与国法思维之间需要保持必要区隔。于此限度内,法治化并不具有先验的至上价值,努力将党的各项主张转化为高效合理的治理措施,并在治理实践中达致最大的政治效能应是当下及未来党内法规制度建设的目标。
Promoting the institutional construction of the party’s regulations is a necessary requirement for the rule of law-based governance over the CPC.The rule of law within the Party,created through a rigorous system of regulations,can effectively address the crisis of representativeness and progressiveness faced by the existing political structure,and thus ensure and sustain the“People’s nature”on which it is based.To achieve this goal,based on the dual legal and political attributes of Party’s regulations,it is necessary to focus on two dialectical and unified theoretical dimensions:at the surface level of the institutional framework,the Party’s regulations need to be improved in accordance with the thinking of state law;at the deeper level of the institutional orientation,the necessary distinction needs to be maintained between the rule-based governance over the Party and the thinking of state law.Within these limits,the rule of law does not have a priori supreme value,and efforts to translate the Party’s ideas into efficient and rational measures and to achieve maximum political effectiveness in the practice of social governance should be the ultimate goal of the institutional construction of the Party’s regulations now and in the future.
