摘要
以大数据基础和人工智能技术为核心的人工智能时代,人们社会关系受到深刻影响,犯罪行为在新的技术手段下具有了新的犯罪特征,也为刑事侦查带来更大的难度和障碍。物证技术作为刑事侦查领域的关键方面,在推动刑侦客观公正、响应证据规则新要求、接轨国际社会需要等方面有重要作用。面对新型犯罪尤其是经济犯罪与网络犯罪的隐秘性、技术性、跨地域流窜性,人工智能在固定线索、搜集证据等领域作用突出。其中,区块链技术、机器学习技术与大数据技术作为相对成熟的技术领域,已经与物证技术的融合进行了有益探索,融合效果显著。智慧化的物证技术也在刑事侦查领域的视频侦查、生物特征识别侦查和情报数据智能研判等方向具有较强的实践性,是当前智慧侦查的探索范例。
In the era of artificial intelligence based on big data and artificial intelligence technology,people's social relations are profoundly affected,and criminal behavior has new criminal characteristics under the new technical means,which also brings more difficulties and obstacles to criminal investigation.As a key aspect in the field of criminal investigation,physical evidence technology has an important role in promoting the objectivity and fairness of criminal investigation,responding to the new requirements of the rules of evidence and aligning with the needs of the international community.In the face of new crimes,especially economic crimes and cybercrime,which are secretive,technical and cross-territory roaming,artificial intelligence plays a prominent role in fixing clues and collecting evidence.Among them,blockchain technology,machine learning technology and big data technology as a relatively mature technology field has been useful exploration with the integration of physical evidence technology,the integration effect is significant.Intelligent physical evidence technology also has a strong practicality in the direction of video investigation,biometric investigation and intelligence data intelligent research and judgment in the field of criminal investigation,which is the current exploration example of intelligent investigation.
