摘要
2006年陈兴良教授发表《刑法知识的去苏俄化》一文,标志着刑法知识“去苏俄化”潮流的初步展开。邵六益博士《法学知识“去苏俄化”的表达与实质——以刑法学为分析重点》一文,从政法法学的视角对法学知识特别是刑法学知识的“去苏俄化”命题提出批评。该文认为,法学知识的“去苏俄化”命题,表面上是试图“去政治化”,实际上却陷入另一种政治逻辑,亦即西方式的“自由主义”的刑法模式。应该说,该文对“去苏俄化”命题存在诸多误解和过度解读,其中最大的问题是赋予“去苏俄化”过多的政治含义,后者源于政法法学对政治的过度关注,容易使法学成为政治的附庸。中国刑法学没有单独的政治逻辑,而是以刑法典的政治逻辑作为自己的当然逻辑。刑法知识的“去苏俄化”命题,既没有全面搁置价值判断,也没有隔断政治因素通过刑事政策进入刑法的可能,因此,没有割裂刑法与政治的良性沟通关系。
In 2006,Professor Chen Xingliang published his article De-Sovietization of Criminal Law Knowledge,marking the initial development of"de-Sovietization"of criminal law knowledge.Dr.Shao Liuyi criticized the proposition of"de-Sovietization"of legal knowledge(especially criminal law knowledge)from the perspective of political jurisprudence in his article The Expression and Essence of"De-Sovietization"in Chinese Legal Studies.Dr.Shao’s article argues that the proposition of"de-Sovietization"tries to"depoliticize"on the surface,but actually falls into another political logic,that is,the criminal law model of western"liberalism".In his article there are many misunderstandings and excessive interpretations of the proposition of"de-Sovietization",among which the biggest problem is to assign too much political connotation to"de-Sovietization".The de-Sovietization of criminal jurisprudence has no separate political logic,but takes the political logic of criminal code as its own logic.In fact,the proposition of"de-Sovietization"of criminal law did not completely shelve value judgment,nor did it cut off the possibility of political factors entering criminal law through criminal policy",so it did not sever the benign communicative relationship between criminal law and politics.
