摘要
民事诉讼案件长期未结一直是法院审判工作中的老大难问题。案件长期未结违背了我国司法公平与效率的基本价值追求,也违背了我国审限制度设立的目的,诉讼案件长期未结危害甚大。文章试图从实证角度对L省法院长期未结案件原因进行分析,并从已结和未结的长期未结诉讼案件中找寻共性,总结归纳案件未结的主客观因素和现实原因,并找出有效解决的对策方案,杜绝长期未结诉讼案件的发生。
The long-term unsettled civil litigation cases have always been a difficult problem in the judicial work of the court.Long-term unsettled cases go against the basic value pursuit of judicial fairness and efficiency in our country,and also go against the purpose of setting up the trial limit system in our country.A long period of unsettled litigation is a great danger.This article tries to analyze the reasons of the long-term unsettled cases in court of our province from the empirical perspective,to find the common ground from the long-term settled and unsettled cases,and to sum up the subjective and objective factors and realistic causes of unsettled cases.The aim is to find effective solutions to eliminate long-term unsettled litigation cases.
