摘要
古籍的保护、修复和活用,关乎中华文脉的延续与传承。目前古籍保护领域缺乏明晰的管理权属、保护标准、工作机制、人才培养等保障体系,亟须通过立法强化古籍的保护与传承。信息生态理论有利于复杂系统的理论建构,能够为古籍保护立法研究提供新的视角。文章基于信息生态理论构建了古籍保护生态系统模型,深度剖析了古籍保护系统中的各个构成要素,识别为保障生态系统良性循环各构成要素的关键节点问题,审视可能导致古籍保护生态系统失衡的痛点、难点,最后提出古籍保护立法应首先确定立法的核心主体,侧重确定责任主体进行统筹管理,重视协同机制、激励机制及质量控制机制的建立。
The preservation,restoration and use of ancient books are related to the continuity and transmission of Chinese culture.At present,there is a lack of clear management ownership,protection standards,working mechanism,personnel training and other security systems in the field of ancient books preservation.It is urgent to strengthen the preservation and inheritance of ancient books through legislation.The information ecology theory is conducive to the theoretical construction of complex systems and can provide a new perspective for the study of ancient books preservation legislation.Based on the information ecology theory,this paper constructs a model of ancient books preservation ecosystem,deeply analyzes the elements of ancient books preservation system,identifies the key nodes to ensure the virtuous cycle of ecosystem,examines the pain points and difficulties that may lead to the imbalance of ancient books preservation ecosystem,and finally puts forward that the legislation of ancient books preservation should first determine the core subject of legislation,focus on determining the responsible subject for overall management,and attach importance to the establishment of coordination mechanism,incentive mechanism and quality control mechanism.
