摘要
基层检察机关在开展未成年人保护检察公益诉讼工作过程中,因存在监督不充分不积极、监督水平不高、监督不全面、监督效果不理想等问题,严重影响了此项工作的规范化发展。造成这些问题出现的原因包括基层检察机关案多人少、检察官办案精力不足、缺少有效的学习培训机制、办案人员习惯于坐堂办案实地踏查少、省市两级检察机关考评指标未充分发挥指挥棒作用、行政机关对检察机关监督存在抵触心理、公益诉讼监督缺乏必要刚性。基层检察机关应通过优化成员结构抓住监督重点、提高重视程度自觉补足短板、加强部门内部协作多渠道拓展案源、合理调整考评指标、积极转变办案观念、加强沟通协作构建未成年人保护双赢多赢共赢新格局,加快构建制度保障增强公益诉讼监督刚性等方式对上述问题进行解决。
When basic procuratorial organs carry out public interest litigation for the protection of minors,there are problems such as insufficient and inactive supervision,low level,incompleteness,and unsatisfactory results,which seriously affect the development of standardization.The reasons are that there are many cases of basic procuratorial organs,insufficient energy of prosecutors,few on-the-spot investigations,lack of effective learning and training mechanism,the evaluation index of procuratorial organs does not give full play to the role of baton,the administrative organs have a resistance to the supervision of procuratorial organs,and the supervision of public interest litigation lacks the necessary rigidity.Basic procuratorial organs should optimize the structure of members,grasp the key points of supervision,increase the degree of attention,consciously make up for the shortcomings,strengthen the internal cooperation of departments,expand the source of cases through multiple channels,rationally adjust the evaluation indicators,actively change the concept of handling cases,strengthen communication and cooperation,build a new pattern of win-win protection for minors,accelerate the construction of institutional guarantees,and enhance the rigidity of public interest litigation supervision.
