摘要
维护进城落户农民合法土地权益,应首先明确进城落户农民是具有主体指向性、阶段过渡性、现实长存性、时代性的特殊农民群体,其土地权益应包括土地承包经营权、宅基地使用权及其相关权益。当下,应详细梳理进城落户农民合法土地权益保障困境的利益主体多元、侵害行为隐蔽等表因,解答农村产权个体归属、进城落户农民成员身份、权益属性抉择等深层疑问。进城落户农民合法土地权益保障的策略,应以平等与自愿为价值导向,通过涉农改革进一步彰显土地权益之财产性,构建法治化与渐进市场化的有偿退出与转让机制,并依据其成员身份保留这一群体在农村的后路,使进城落户农民各取所需、进退皆宜。
To safeguard the legitimate land rights and interests of farmers who have migrated to cities,it is important to recognize that these farmers are a special group with distinct characteristics including a subject orientation,transitional phase,long-term reality,and modernity.Their land rights and interests should include the right to land contractual management,the right to use homesteads,and related rights and interests.At present,it is necessary to examine the complex factors that hinder the protection of their legitimate land rights and interests,including multiple stakeholders and covert violations.Additionally,deeper questions must be addressed regarding individual ownership of rural property rights,confirmation of the identity of farmers who have migrated to cities,and striking a balance between identity and property rights.Strategies for protecting the legitimate land rights and interests of farmers who have migrated to cities should be guided by values of equality and voluntariness.Through agricultural-related reforms,the property nature of land rights and interests should be further demonstrated,and a paid withdrawal and transfer mechanism should be established through the legalization and gradual marketization of land rights.
