摘要
法典化是国家法领域的专门概念,党内法规法典化主张渊源于法律法典化说,但该观点模糊了党内法规与法律之间的界限,缺乏法理基础和实践依据。法典化并非通往党内法规体系化的唯一路径,党内法规体系化不等于党内法规在规范上呈现“法典化存在形式”,但可以借鉴“法典化思维方式”。党内法规体系化的主要目的在于实现党内法规之间的融贯协调,推进党内法规体系化的方式是丰富多样的,包括集成型、汇编型和单行法规型,三种方式有机统一,任何一种方式都有其他方式不可替代的价值。
Codification is a specialized concept in the field of state laws.The proposition of codifying Party rules and regulations stems from the theory of Codification,blurring the boundary between Party rules and regulations and the law with a lack of jurisprudential and practical basis.Codification is not the only way to the systematic construction of Party rules and regulations.At the same time,the systematic construction of Party rules and regulations is not equivalent to the"existing form as a code"in terms of norms,but it is advisable to improve the systematic construction of Party rules and regulations by drawing on the"codification-inspired way of thinking".The main purpose of the systematic construction of Party rules and regulations is to achieve the harmonized coordination among them.Meanwhile,there are multiple ways to carry out the systematic construction and they may be categorized as the mode of integration,the mode of compilation and the mode of a separate rule or regulation.These three modes are an organic unity,each of which has unique value that cannot be replaced by others.
