零工经济下劳动者权益保障的困境与完善路径

摘要 随着互联网信息技术的快速发展,一大批新就业形态和灵活就业岗位应运而生。灵活就业作为一种重要的新就业形态,在稳增长、促就业方面发挥了重要作用。新型用工模式对传统劳动法律和制度提出了一连串挑战,零工劳动者的权益保障困境也日益凸显。以典型的零工劳动者——外卖骑手为例,反思我国零工经济发展实际中维护零工劳动者权益存在的不足,我国应当灵活并恰当认定零工劳动者的法律身份,明确认定劳动关系,逐步更新并完善相关劳动法律和制度体系,监督企业合理构建算法技术治理机制,通过多方主体协同努力,以期走出零工劳动者权益保障困境,促进零工经济健康持续发展。 With the rapid development of internet information technology,a large number of new forms of employment and flexible employment positions have emerged.Flexible employment,as an important new form of employment,has played an important role in stabilizing growth and promoting employment.The new employment model has posed a series of challenges to traditional labor laws and systems,and the dilemma of protecting the rights and interests of short-term hired labors is becoming increasingly prominent.Taking a typical short-term hired labor——a food delivery rider as an example,this article reflects on the shortcomings of safeguarding the rights and interests of short-term hired labors in the actual development of China's gig economy.China should flexibly and appropriately recognize the legal identity of short-term hired labors,clearly recognize labor relations,gradually update and improve relevant labor laws and institutional systems,supervise enterprises to build a reasonable algorithm technology governance mechanism,and work together through multiple parties,in order to get out of the dilemma of protecting the rights and interests of migrant workers and promote the healthy and sustainable development of the gig economy.
