摘要
文章通过文献研究、案例分析、统计分析的方法对我国农村土地流转的基本情况进行分析。研究土地流转中政府、村组委、企业及农民这些主要的利益主体,梳理不同利益主体的利益诉求,并对这些利益诉求进行分析探讨,由此找出流转主体间的利益冲突点,以较为全面、公正、客观的态度将土地流转过程中各个流转主体的利益诉求及利益冲突呈现出来。并对流转过程中利益冲突产生的原因深入分析,发现农村土地流转市场机制不完善、产权不明晰,流转过程不规范等,都是引起流转利益冲突的主要原因。研究最后,提出解决土地流转利益冲突的防范对策以解决流转主体利益冲突。
This paper analyzes the basic situation of Chinese rural land circulation through the methods of literature research,case analysis and statistical analysis.This paper studies the interest subjects of land transfer and the causes of interest conflicts,and concludes that the interest subjects of land transfer mainly include government,village committee members,de⁃velopers and farmers.According to the conflict theory,this paper analyzes the interest appeals of transfer subjects,discusses the interest appeals that transfer subjects care about and pay attention to,so as to find out the interest conflict points among transfer subjects,and analyze the interest appeals and interests of each transfer subject in the process of land transfer in a more comprehensive,fair and objective manner It pops out.It also analyzes the core interest demands of the transfer subject.Through analysis and research,it is found that the changes of rural land policy and system,imperfect transfer market mechanism,unclear property rights,non-standard transfer process,and unfair distribution of rural land value-added income are the main reasons for the conflict of interest in transfer.Finally,the paper puts forward countermeasures to solve the conflict of interest in land transfer,including improving relevant laws and regulations,strengthening the protection of land-lost farmers,improving the income distribution system of farmland transfer,and improving the legal awareness of farmers in land transfer,so as to solve the conflict of interest of the transfer subject.
