摘要
民法典既是立法理性化的私法成果,也是承载政治功能的法律文本。现代政治是基于法律调控下的规则治理,民法典与社会主义民主政治的逻辑关系是一项值得探讨的论题。发掘我国民法典的世界性贡献,应科学认知新中国以来的民主政治实践。我国民法典蕴藏着全过程人民民主的意涵,各编的公法规范内容彰显了“社会主义性质”的民主政治理念。应通过互动性视角审视民法典实施与社会主义民主政治的内在逻辑,从规范公权力行使效果、畅通民法典与政治法衔接、民法典精神强化政治文明秩序等路径上推动二者的全过程互动,切实发挥民法典对中国式现代化的积极意义。
The Civil Code is not only the result of the rationalization of legislation in private law,but also the legal text bearing political functions.Modern politics is based on rule governance under the control of law.The logical relationship between civil code and socialist democratic politics is a topic worthy of discussion.To explore the world significance of China's Civil Code,we should scientifically recognize the democratic political practice since the founding of the People's Republic of China.Our civil code contains the meaning of people's democracy in the whole process,and the contents of the public law norms in each part highlight the democratic political concept of "socialist nature".We should examine the internal logic between the implementation of the civil code and socialist democratic politics from the perspective of interaction,and promote the interaction between the two in the whole process from the aspects of standardizing the effect of the exercise of public power,unblocking the connection between the civil code and political law,and strengthening the political civilization and order in the spirit of the civil code,so as to give full play to the positive significance of the civil code for national governance.
