摘要
刑事在线庭审是互联网时代刑事司法发展的产物,受到了广泛关注,被赋予了较高期待。结合刑事在线庭审的演进过程和实际运行,可以看出,当前刑事在线庭审主要发挥着工具价值,被偏重于作为某种办案提速提效工具来构建和应用。这虽然使刑事在线庭审在短期内取得了一些实效,并收获了不少认可,但也导致了诸如权利保障不足、功能发挥不够、增加安全风险等问题和弊端。长远来看,制约了刑事在线庭审的优化和发展。在未来,应当以程序公正优先为导向,通过加强权利保障、强化庭审功能、增强庭审安全等路径,对刑事在线庭审加以发展完善。
Criminal online trial is a product of the development of criminal justice in the Internet age and has received widespread attention and high expectations.Combined with the evolution process and actual operation of criminal online trial,the current criminal online court trial mainly plays a tool value,and focuses on the construction and application as a tool to speed up and improve efficiency in handling cases.Although it has achieved some effectiveness and gained a lot of recognition in the short term,it has led to issues and drawbacks such as insufficient protection of rights,inadequate functioning,and increased security risks.In the long run,it restricts the optimization and development of criminal online trials.In the future,criminal online trials should be regulated and improved by giving priority to procedural justice and strengthening rights protection,court trial functions,and court trial safety.
