摘要
养老服务社会化后,地方政府选择性履行职能强化了社会组织的志愿失灵风险,导致养老服务质量降低或供给中断,对老年人的基本权利产生不利影响。这种现象的本质是政府对基本权利的保护不足,其形成与当前对行政权的功能主义约束模式密切相关。框架性立法的局限、行政规范性文件的短板、行政系统内部监督的限度,均在不同程度上造成了地方政府选择性履行职能。为了治理这种现象,应当充分发挥立法的矫正功能,补强政府自我规制的不足,迈向兼顾“促进养老服务发展”与“保障老年人权益”的统一养老服务立法。同时,要通过提升行政程序的明确性以平衡实体规范的模糊性,提升行政部门之间职能配置的明确性以弱化部门碎片化的影响,提升法律责任的明确性以有效对接外部监督。
After the socialization of elderly care service,the selective performance of their functions by local governments strengthens the risk of voluntary failure of social organizations,leading to the reduction of the quality of elderly care service or the interruption of supply,which has a negative impact on the basic rights of the elderly.The essence of this phenomenon is the insufficience of government protection on basic rights,and its formation is closely related to the current functionalist restraint mode of administrative power.The limitations of framework legislation,the shortcomings of administrative normative documents and the limits of internal supervision of the administrative system all lead to the selective performance of the functions of local governments to varying degrees.In order to this phenomenon,we should give full play to the correction function of legislation,strengthen government self-regulation,and move towards a unified elderly care service legislation that focuses both on“promoting the development of elderly care services”and“protecting the rights and interests of the elderly”.Meanwhile,it is necessary to increase the clarity of administrative procedures to balance the ambiguity of substantive norms,stengthen the clarity of the allocation of functions among administrative departments to reduce the impact of departmental fragmentation,and enhance the clarity of legal responsibility to ensure efficiency of external supervision.
