摘要
数字技术的广泛运用塑造了全新的生活模式,数字弱势群体面临新的生活障碍,而传统的物质帮助在数字化生活中难以实现维持生活需要的目的。从法理视角看,有必要将弱势群体的帮助内容由物质帮助拓展至技术帮助,赋予公民请求国家提供技术帮助的权利。技术帮助权以年老、疾病或丧失劳动能力的公民为典型主体,以维持公民生活需要为请求权内容,以捍卫人的尊严为保障目的,与物质帮助权的基本要素契合为技术帮助权融入物质帮助权提供技术路径。作为新兴权利的技术帮助权可以通过文义解释、原意解释与结构解释被物质帮助权吸纳,从而推定为物质帮助权的衍生权利。
The extensive use of digital technology has shaped a new life style,which makes vulnerable groups lacking digital skills face living obstacles,and traditional material help is not enough to maintain life needs.From the legal perspective,it is necessary to expand the help content of vulnerable groups from material assistance to technical assistance,and give citizens the right to request the state to provide technical assistance.The right to technical assistance takes the elderly,the sick and the disabled as the typical subjects,the maintenance of citizens’life needs as the content of the right of request,the protection of human dignity as the purpose of protection,and the coincidence with the basic elements of the right to material assistance provides an opportunity for the right to technical assistance to be integrated into the right to material assistance.As an emerging right,the right to technical assistance can be accommodated the right to material assistance by constitutional norms through textual interpretation,original meaning interpretation and structural interpretation and can be the presumed derivative right of the right to material assistance.
