摘要
通过全面和系统地回顾和总结新中国成立以来“中国式现代化”从理念到制度并且最终得到政策的确认的历史发展过程,详细地论述了法治在确认和保障“中国式现代化”中所起到的重要制度保障作用。在此基础上,基于对党的二十大报告所提出的“中国式现代化”的五项基本特征和九项本质要求,全面阐述了法治与“中国式现代化”之间的辩证关系,指出“中国式现代化”的法治保障主要是通过法治确认“中国式现代化”的五项基本特征的地位和保障九项本质要求得到满足的状态来为“中国式现代化”提供具体和明确的制度保障。此外,通过论述习近平法治思想的“以人民为中心”的核心要义,突出强调了法治的人民性和“中国式现代化”的人民性。强调必须以人民为中心,运用法治手段来有效推进“中国式现代化”建设,必须要充分发挥人民在实现“中国式现代化”中的主人翁作用,通过法治保障全体中国人民在实现“中国式现代化”中的主动权、话语权和决定权。
By comprehensively and systematically reviewing and summarizing the historical development of“Chinese Path to Modernization”since the founding of the People's Republic of China from concept to system and finally being confirmed by policies,this paper discusses in detail the important role of the rule of law in the recognition and protection of“Chinese Path to Modernization”.On this basis,based on the five basic characteristics and nine essential requirements of the“Chinese Path to Modernization”proposed in the Report of the 20th National Congress of the Communist Party of China,the dialectical relationship between the rule of law and the“Chinese Path to Modernization”was comprehensively expounded.It points out that the legal guarantee of“Chinese Path to Modernization”is mainly to provide specific and clear institutional guarantee for“Chinese Path to Modernization”by confirming the status of the five basic characteristics of“Chinese Path to Modernization”and ensuring that the nine essential requirements are met.It emphasizes that the people must be the center and the rule of law must be used to effectively promote the construction of“Chinese Path to Modernization”.It is necessary to give full play to the role of the people as the masters in realizing“Chinese Path to Modernization”,and ensure the initiative,voice and decision-making power of all Chinese people in realizing“Chinese Path to Modernization”through the rule of law.
