摘要
房产类国有资产租赁争端问题的根源,在于一些老旧房产存在问题与瑕疵、承租户经营过程的市场风险、国有资产管理制度的不健全等。为确保国有资产管理,探讨协商民主的内涵和作用,着重运用协商民主方法,排除租赁争端,从而达成和解作用。建议从源头加强管理,健全租赁风险防控,在思想上提高担当意识,在制度上提高规范意识,在机制上提高合力意识,在服务上提高前置意识,在监督上提高防范意识。以制度化、规范化、程序化为标准,建立资产租赁争端的协商民主化解机制,为国有资产保值增值提供全方位的有力措施与保障。
The root cause of the disputes over the lease of state-owned property is the problems and flaws in some old properties,the market risks in the lessee's business process,and the imperfect management system of state-owned assets.In order to ensure the management of state-owned assets,discuss the internal letter and role of consultative democracy,and focus on the use of consultative democracy methods to eliminate lease disputes and reach a settlement,it is recommended to strengthen management from the source,improve the prevention and control of lease risks,improve the sense of responsibility in ideology,improve the sense of standardization in systems,improve the sense of joint efforts in mechanisms,improve the sense of pre emption in services,and improve the sense of prevention in supervision.With institutionalization,standardization and proceduralization as the standard,we will establish a consultative and democratic resolution mechanism for asset leasing disputes,and provide comprehensive and powerful measures and guarantees for the preservation and appreciation of state-owned assets.
