摘要
农业是立国之本,社会生产力不断提高,促进农业生产技术水平提升,农业知识产权法律保护问题逐渐显现。切实保障农业知识产权不受侵犯,是实现中国农业现代化转型,提升中国农业国际竞争力的重要基础。相关研究人员立足于农业知识产权法律保护现状,深入分析农业知识产权概念与特征,针对执法过程存在瑕疵、法律保护意识有待加强等问题进行深入分析,制定一系列农业知识产权法律保护优化措施,包括强化法律意识,明确主体责任等内容。以期为农业稳定健康发展,提供更为完善的法律保障。
Agriculture is the foundation of a country. With the continuous improvement of social productivity and the promotion of agricultural production technology, the legal protection of agricultural intellectual property rights has gradually emerged. Ensuring that agricultural intellectual property rights are not infringed is an important basis for realizing China’s agricultural modernization transformation and enhancing China’s agricultural international competitiveness. Based on the status quo of legal protection of agricultural intellectual property rights, relevant researchers analyzed the concept and characteristics of agricultural intellectual property rights, made in-depth analysis on problems such as flaws in the law enforcement process and the need to strengthen legal protection awareness, and formulated a series of measures to optimize the legal protection of agricultural intellectual property rights, including strengthening legal awareness and clarifying subject responsibilities. It is expected to provide a more perfect legal guarantee for the stable and healthy development of agriculture.
