摘要
随着我国卫生法治建设的深入,医学教育人才的培养工作受到越来越多的关注。由于现有相关法律存在的漏洞和临床教学工作的特殊性,临床实践教学过程中的法律风险治理存在权益保障法律制度不完善、实习生诊疗行为不规范、临床实践教学中多方权益冲突、实习生的法律风险意识培养力度不足等现实困境。应该建立完善的法律风险预防与处理体系,在制度上细化对各方主体权益的法律保障,提高实习生实践规范水平,加强教学主体的法律风险意识,有效规避法律风险,形成良好的临床实践教学环境。
With the deepening of the construction of the rule of law in health in China, the training of medical education talents has received more and more attention. Due to the loopholes in the existing relevant laws and the particularity of clinical teaching work, the legal risk management in the process of clinical practice teaching has imperfect legal system for rights protection, irregular medical practice behavior of interns, conflicts of rights and interests of multiple parties in clinical practice teaching, Practical difficulties such as insufficient training of interns’ legal risk awareness. It is proposed to establish a perfect legal risk prevention and treatment system, to refine the legal protection of the rights and interests of all parties in the system, to improve the level of practice norms of interns, and to strengthen the legal risk awareness of teaching subjects, effectively avoid legal risks, and form a good clinical practice teaching environment.
