学位获得权保护的三重困境与制度重构

摘要 学位获得权虽未在立法层面得到明确规定,但其作为公民受教育权结束阶段的“学习成功权”的重要体现,应当在教育实践中得到社会的充分认可和保护。通过对51份校生学位纠纷裁判文书进行分析,发现学生在维护学位获得权时面临学位授予标准不明朗、学位管理程序不规范、权利救济实效不明显等现实困境。为促进学位纠纷的顺利解决和《学位法》与教育法典的有机融合,有必要从立法层面对学位获得权保护进行制度完善,包括学位授予标准的规制化、学位管理程序的合法化以及学位获得权救济机制的多元化。 Although the right to obtain a degree has not been clearly stipulated at the legislative level,as an important embodiment of the"right of learning success"at the end of citizens'right to education,it should be fully recognized and protected by the society in educational practice.Through analyzing the 51 judgment documents of degree disputes,it has been found that students face some practical difficulties,such as unclear degree-conferring standards,nonstandard degree management procedures,and weak effectiveness of rights relief.In order to promote the resolution of degree disputes and the integration of the Degree Law and the Education Code,it is necessary to improve the protection system of the right to obtain degrees from the legislative level,including the regulation of degree-conferring standards,the legalization of degree management procedures and the diversification of the relief mechanism of the right to obtain degrees.
