摘要
农村土地经营权流转纠纷的频繁发生对农村土地流转市场的发展产生不利影响,为进一步规范农村土地流转市场,土地流转履约保证保险应运而生。本文从理论层面剖析保险实施效果的作用路径和不同村庄之间存在差异的原因,并基于江苏省H市的调研数据和相关案例予以佐证。结果表明:土地流转履约保证保险的实施在一定程度上起到了规范土地流转市场的作用,总体上实现了降低土地流转风险、提高土地流转积极性、维护村集体和农户利益的政策目标;但政府投入和宣传力度不足、村集体政策知晓情况不佳、保险公司赔付效率低下且交易成本较高等问题使得土地流转面积后期出现下降趋势,保险整体的续保情况亦不容乐观;村集体由于经济水平、风险意识及原有防范措施效果各不相同,造成参保与续保率、违约状况变化及对保险满意度存在较大差异。基于此,本文提出相关建议以期进一步规范农村土地经营权有序流转,健全完善农村土地流转风险防范机制。
The frequent occurrence of disputes over the transfer of rural land management rights has an adverse impact on the development of land transfer market.In order to further regulate rural land transfer market,land transfer performance guarantee insurance came into being.This paper analyzes the action path of insurance implementation effect and reasons for differences between different villages from theoretical level,and provides evidence based on survey data and relevant cases in H City,Jiangsu Province.The results show that the implementation of land transfer performance guarantee insurance has regulated land transfer market to a certain extent,and has achieved the policy objectives of reducing the risk of land transfer,improving the enthusiasm of land transfer and safeguarding the interests of village collectives and farmers.However,problems such as lack of government investment and publicity,poor policy awareness of village collective,low claim settlement efficiency of insurance companies and high transaction costs have led to a downward trend in the land circulation area in later stage,and the overall renewal of insurance is not optimistic;Due to different economic level,risk awareness and effect of the original preventive measures of different village collectives,there are great differences in the participation and continuous participation rate of insurance,change of default action and degree of satisfaction with the insurance.So,this paper puts forward relevant suggestions in order to further standardize orderly transfer of rural land management right and improve risk prevention mechanism of rural land transfer.
