摘要
百年来,中国共产党领导中国人民持续探索中国式法治现代化新道路,致力于构建中华法治文明新形态,创造人类历史上最先进的法治文明。中华法治文明新形态,既吸纳了人类法治文明优秀成果,又超越了既往法治文明形态。从根本属性看,坚持以人民为中心,把践行民主、反映民意、保障民权、改善民生、赢得民心贯穿于法治运行全过程,充分彰显中华法治文明的人民性。从体制构架看,坚持民主集中制,发挥党的领导优势,确立起既有集中统一又有分工负责、既有协作又有制约、既有公正又有效率的新法治体制。从价值理念看,坚持高位阶价值观,容纳更为多元的价值目标,追求更高层次的价值理想,建立起更高境界的法律价值体系。从创新动能看,坚持科技引领,主动拥抱新一轮科技革命,把科技伟力转化为法治伟力,开辟出更加美好的未来法治图景。从规模效能看,坚持“大法治观”,构建全方位、全覆盖、全链条的新型法治样态,展现出中华法治文明的大视野大格局。
Over the past 100 years, the CPC has led the Chinese people to continue to explore a new path of Chinese modernization of the rule of law, committed to building a new form of Chinese civilization of the rule of law, and created the most advanced civilization of the rule of law in human history. The new form of Chinese civilization of the rule of law not only absorbs the excellent achievements of human civilization of the rule of law, but also surpasses the previous forms of civilization of the rule of law. From the perspective of fundamental attribute, it takes a people-centered approach, and practices democracy, reflects public opinion, protects people’s rights, improves people’s livelihood, and wins people’s hearts throughout the entire process of the operation of the rule of law, and fully demonstrates the people’s nature of Chinese civilization of the rule of law. From the perspective of institutional framework, it adheres to democratic centralism, gives play to the Party’s leadership advantages, and establishes a new system of the rule of law with centralization and unification and the division of labor with individual responsibility, coordination and restraint, and fairness and efficiency. From the perspective of value concept, it persists in the high standard of values, accommodates more diversified value goals, pursues a higher plane of value ideals, and establishes a higher level of legal value system. From the perspective of innovation momentum, it upholds the guidance of science and technology, actively embraces a new round of scientific and technological revolution, transforms the great power of science and technology into the great power of the rule of law, and opens up a better picture of the future rule of law. From the perspective of scale and efficiency, it adheres to the great concept of the rule of law, builds an all-round, full-coverage and full-chain new model of the rule of law, and shows the general vision and pattern of Chinese civilization of the rule of law.
