摘要
诉讼中,合理确定知识产权损害赔偿额是法官面临的重要议题,而我国现行法律规定的赔偿额计算方法却存在着一定的缺陷。综合来看,将资产评估方法引入损害赔偿额的确定是弥补这些缺陷的有效措施。本文以建立既符合知识产权价值规律又符合我国资产评估现状的知识产权损害赔偿评估方法体系为目标,以知识产权价值理论及资产评估理论为基础,结合我国司法实践,对知识产权损害赔偿评估方法进行选择并提出相应的完善建议。
In judicial practice, how to determine damages of intellectual property is a difficult issue faced by judges, and there are some defects in the method of determining the amount of compensation stipulated by the relative laws in China. Introducing the method of assets evaluation into the determination of intellectual property damages is an effective measure to solve the problem. This paper aims to establish a system for evaluating intellectual property damages which is in line with the law of intellectual property value and the current situation of assets appraisal, selects the proper appraisal methods of intellectual property damages and puts forward to suggestions based on the theories of intellectual property values and asset appraisal and combined with Chinese Judicial practice.
