摘要
妨害传染病防治罪在打击相应违法犯罪和维护社会秩序中发挥重要作用的同时,也存在适用规范性不够等问题。这既是立法规定未尽明确而给构成要件留有过多解释空间所致,也是不完善的司法解释给法律适用带来混乱的结果。基于罪刑法定原则的边界与底线的法治要求,解决本罪法律适用问题的路径,主要是基于法秩序统一原理,将特定妨害传染病防治行为纳入包含《刑法》《传染病防治法》等的法律体系中;运用《刑法》第十三条的但书规定,合理衔接行刑关系;准确界分罪与非罪、此罪与彼罪,作出既合法又合理的定性裁判。
While the crime of obstructing the prevention and treatment of infectious diseases has played an important role in combating corresponding crimes and maintaining social order,it also has problems such as insufficient application of normative measures.This is not only because the legislative provisions are not clear enough,leaving too much room for interpretation of the constituent elements,but also because the imperfect judicial interpretation brings confusion to the application of the law.Based on the rule of law requirements of the boundary and bottom line of the principle of legality,the path to solve the problem of the application of the law for this crime is mainly based on the principle of unity of legal order,incorporating specific acts that hinder the prevention and control of infectious diseases into the legal system including the criminal law,the law on the prevention and treatment of infectious diseases,et cetera.By using the proviso of Article 13 of the Criminal Law,the relationship between crime and administrative violation shall be reasonably connected,and the guilt and non-crime,this crime and that crime shall be accurately distinguished,and a qualitative judgment that is both legal and reasonable shall be made.
