摘要
《民诉法解释》第109条将五类特殊待证事实的证明标准提高至“排除合理怀疑”的程度,但由于对其内涵的理解尚未达成共识,司法实践中常存在民事、刑事诉讼证明标准相混同以及证明标准层次性体现不足的问题。为更好地提升诉讼的效率性与公正性,可以考虑对民事、刑事诉讼证明度标准进行界定,进一步明确民刑证明标准在证明区间内的层次差异。同时,认识到坚持“怀疑”合理性,坚持民刑证明标准相区别,强化案例指导,防范自由裁量权滥用等民事诉讼层次化证明体系的优化路径,对于我国民事诉讼证明标准的未来设计也具有重要意义。
Article 109 of the interpretation on the application of Civil Procedure Law raises the standard of proof of five special facts to be proved to the level of“beyond reasonable doubt”.In the judicial practice,there are many problems such as the confusable standards of proof in civil and criminal proceedings and fuzzy level of the standards of proof.In order to improve the efficiency and fairness of the lawsuit,it is necessary to define the degree of proof of the lawsuit and analyze the difference of the standards of proof in civil and criminal cases.At the same time,it is significant for the future development of the standards of proof in civil proceeding to realize the optimization path of the hierarchical proof system by clearing standards of proof in civil and criminal proceedings,standardizing case guidance,and preventing the abuse of judicial discretion.
