摘要
人民法庭主要设置在农村或者城乡接合部,是基层人民法院的派出机构,代表国家依法行使审判权,新时期、新变化对司法审判工作提出了更新更高的要求,如何让人民法庭功能从单一走向多元化,案件审理从全面走向专业化,通过多种方式实现基层社会治理体系现代化运行,从而根源性化解各类矛盾纠纷,是司法工作中亟待解决的难题,探讨当前人民法庭参与基层社会治理面临的问题与困境,有助于探索优化人民法庭在基层社会治理中的职能作用,助力人民法院为基层社会治理提供更加有效的司法保障。
People’s courts are mainly located in rural areas or in the urban-rural interface, which are the dispatched organs of the basic-level courts, exercising the judicial power on behalf of the state according to law.New period and new change put forward newer and higher request to the judicial trial work.How to make the functions of the people’s court from single to pluralistic, the trial of cases from all-round to professional, and realize the modernized operation of the grassroots social governance system by various ways, so as to resolve all kinds of conflicts and disputes at the root, is a difficult problem to be solved urgently in judicial work.To probe into the problems and dilemmas faced by the people’s courts in participating in the grassroots social governance at present is helpful to explore and optimize the functions of the people’s courts in the grassroots social governance, and to provide more effective judicial protection for grassroots social governance.
