摘要
重大突发事件应对中规范供给不足,与应急处置措施“超常规”使用构成了当下应急决策指挥法治化的基本困境,对此难以简单地通过解释论予以纾解。基于历史以及结构功能的双重维度,可以窥见应急决策指挥正由部门决策—有限配合型、政府决策—部门联动型,向党委决策—政府治理型转变。其演进的内在机理源于传统的“知识—权力”技术规制模式存在结构缺陷,难以适应系统性风险带来的复杂管理需求。风险治理理论为重大突发事件应急决策指挥的法治化转型提供了契机,应当发挥政治动员的制度优势,在总体国家安全观视域下优化决策指挥的组织结构,对应急决策指挥权进行合理合法规制,将公众参与嵌入决策指挥程序规范的调控范围,同时建立完善纠错及容错机制。
The insufficient supply of legal norms in the response to unconventional emergencies,and the"extraordinary"use of emergency response measures constitute the basic dilemma of the current legalization of emergency decisions,which cannot be easily relieved through interpretation theory.Based on the dual dimensions of history and structural functions,we can see that the emergency decision is changing from departmental decision-making-limited cooperation,and government decision-department linkage,to the committee of CPC decision-government governance.The internal mechanism of the above transformation is that the traditional"knowledge-power"technical regulation model has structural defects and cannot adapt to the complex management needs brought about by systemic risks.On the contrary,the shortcomings of bureaucracy and the generalization of accountability,it has contributed to the randomness and fragmentation of emergency decisions.Risk governance theory provides an opportunity for the legal transformation of the emergency decision in unconventional emergencies.The institutional advantages of political mobilization should be brought into play,and the party-government structure of emergency decisions should be reshaped from the perspective of the overall national security concept.Faced with unknown risks that are difficult to grasp,the regulation of emergency decision power should also be restrained,and appropriate legalization is a more feasible solution.The justification of its legitimacy also depends on embedding public participation into the regulatory scope of emergency decision procedures,and at the same time establishing and improving error correction and fault tolerance mechanisms.
