摘要
乡绅群体是中国古代法制体系中官府和乡村社会的纽带,是国家征收赋税、维护治安和信息传输的重要管道,在基层政权构建、秩序维系和文化传播等方面均做出了重要的贡献。民国以降,乡绅逐渐为乡贤所取代,在乡村治理中的作用也有所减弱。改革开放以来,大量农民进城导致的农村空心化,严重影响了乡村社会的治理生态。如何破解农村治理困境、扭转农村公共事业发展颓势、推动农村治理体系和治理能力的现代化,不仅需要认真总结中国古代乡绅治理的经验,还要借鉴西方乡绅治理的法治要素和契约精神,从而最大限度地发挥乡贤群体建设乡村,造福家乡的积极性。
The gentry group was the link between governments and rural society in ancient legal system in China.It was an important channel for the state to collect taxes,maintain public order and transmit information.It made important contributions to the primary-level governance construction,order maintenance and culture spread.Since the Republic of China,gentry have gradually been replaced by rural sages,and their role in rural governance has been weakened.Since the reform and opening up,rural hollowing caused by a large number of farmers entering cities has seriously affected the governance ecology of rural society.How to solve the dilemma of rural governance,reverse the low development trend of rural public utilities,and promote the modernization of rural governance system and governance capacity?On the one hand,we should sum up carefully China's ancient gentry governance experience;on the other hand,we should learn from the legal elements and contractual spirit of western gentry governance,so as to give full play to the enthusiasm of rural sages to build villages and benefit their hometowns.
