摘要
授权改革试点是新时代我国推进改革创新的法治化路径,明晰其立法条件成熟标准具有重要意义。然而,从当前的法律规范和理论共识中无法找到涵盖相应标准的可行方案,过往试点经验也只是零打碎敲、未成体系,由此导致制度实践中改革效率受限、新法权威性不足等问题。从授权改革试点的规范设计、本质属性和过往实践来看,其立法条件成熟的标准应体现为一种合目的性判断逻辑。该判断在价值目的上,考察试点对改革发展方向和授权预设目标的落实;在规范性目的上,分析试点设计是否明确、具体、可执行,与法律体系是否融贯;在事实目的上,判断试点手段对客观规律和比例原则的遵循;并按照“价值目的—规范性目的—事实目的”之顺序在实践中具体展开。
Temporary Legislation is the legalization path for China to promote reform and innovation in the new era,and it is of great significance to clarify the criteria for mature legislative conditions.However,from the current legal norms and theoretical consensus,it is impossible to find a feasible scheme covering the corresponding standards,and the past pilot experience is only fragmentary and unsystematic,which leads to problems such as limited reform efficiency and insufficient authority of the new law in institutional practice.From the perspective of the normative design,essential attributes and past practice of Temporary Legislation,the standard of mature legislative conditions should be reflected as a purposive judgment logic.In terms of value purpose,the judgment examines the implementation of the pilot project on the direction of reform and development and the preset goal of authorization;For normative purposes,analyze whether the pilot design is clear,specific,enforceable,and integrated with the legal system;At the level of factual purpose,judge whether the pilot means follow the objective law and the principle of proportionality;and it will be carried out in practice in the order of“value purpose-normative purpose-factual purpose”.
