摘要
城市住宅小区物业纠纷是社会深度转型的必然产物,给基层社会治理带来了巨大挑战。现阶段,城市住宅小区物业纠纷治理从主体、渠道、程序、工作机制等方面都呈现出“碎片化”的倾向。原因在于物业纠纷是一种结构复杂、嵌构不良的特殊性矛盾,存在主体重叠性强、矛盾异质性高、利益多重且极易演化、权利义务不均衡等治理难点。全周期协同治理为城市住宅小区物业纠纷的有效化解提供了新的方向,多重治理主体必须有效嵌入到规范的治理框架中,才能形成有机协同的治理结构。
The property dispute in urban residential district is an inevitable outcome of the deep social transformation,which brings great challenges to grass-roots social governance.At this stage,the governance of property dispute shows a tendency of fragmentation from the subjects,channels,procedures,working mechanisms and other aspects.The fundamental reason is that the property dispute is a special contradiction with complex structure and low embedded,and there are different governance challenges such as strong overlap of subjects,high heterogeneity of contradictions,multiple interests that are easy to evolve,and unbalanced rights and obligations.Full cycle management and collaborative governance provide a new direction for the effective resolution of property disputesin urban residential areas.Multiple governance subjects must be deeply embedded into the institutional governance framework to form an organiccollaborative governance structure.
