摘要
由于跨国网络犯罪行为日益普遍化,新型网络犯罪不断涌现,而当前网络犯罪的国际相关立法过于零散和碎片化,因此制定和出台一部统一的打击网络犯罪的国际公约便成为网络安全治理的当务之急。欧美国家主导的《布达佩斯网络犯罪公约》以西方国家的利益诉求为基础,不具有全球性公约的真正开放性和广泛代表性。同时,由于在实体层面定罪机制不明确、程序层面保障机制不合理、执行层面实施状况不乐观,其在新招迭出的跨国网络犯罪面前也显得应对乏力。为克服这种缺陷,以中俄为代表的新兴国家另辟蹊径,坚持以联合国作为缔结平台推进新公约的制定。将“多元化和包容性”的价值理念融入网络犯罪新公约的规范之中,能够合理地解决不同国家、区域在打击跨国网络犯罪中的紧张关系,也能在一定程度上消除各国法律差异,缩小发展中国家与发达国家间的网络安全数字鸿沟。中国应当基于维护国家安全和网络利益的需求,积极参与网络犯罪国际法律文件的缔结,并推动新公约在实体规则和程序规则的建构。
Due to the increasing prevalence of transnational cybercrime,the emergence of new types of cybercrime,and the current international legislation on cybercrime is too fragmented,the formulation and promulgation of a unified international convention against cybercrime has become an urgent task in cybersecurity governance.The Budapest Convention on Cybercrime,led by European countries and the US,is based on the interests of Western countries and does not have the true openness and broad representation of global conventions.At the same time,due to its unclear conviction mechanism at the entity level,unreasonable safeguard mechanism at the procedural level,and poor implementation at the enforcement level,it appears to be weak in the face of the ever-changing transnational cybercrime.In order to overcome this defect,the emerging countries represented by China and Russia have taken a different path and insisted on using the United Nations as a platform for concluding new conventions to promote the formulation of new conventions.By integrating the value concept of“diversity and inclusion”into the norms of the new cybercrime convention,it is possible to reasonably resolve the tensions between different countries and regions in the fight against transnational cybercrime,and to a certain extent,to eliminate differences in national laws and narrow the cybersecurity digital divide in developing countries.Based on the need to safeguard national security and cyber interests,China should actively participate in the conclusion of international legal documents on cybercrime,and promote the construction of substantive and procedural rules in the new convention.
