试论高职学校教师职称评审行为的行政法属性

摘要 高职教师职称评审是一种对高职学校教师名声、地位、利益均产生较大影响的评审、认定行为。高职教师职称评审行为属于国家授权高职学校对其实施的一种管理行为,和高职学校对教师进行的劳动人事管理行为具有本质的不同。文章通过论述职称评审行为的公共性,职称评审过程中申请人和评审主体地位上的不平等性,论证高职学校职称评审属于一种行政行为,应受行政法原则及相关规则的约束。 The professional title evaluation of higher vocational teachers is a kind of evaluation and identification behavior that has a great impact on the reputation,status and interests of teachers in higher vocational schools.Vocational teachers'professional title evaluation behavior is a kind of management behavior authorized by the state to teachers in vocational colleges,which is essentially different from the labor and personnel management behavior of teachers in vocational colleges.This paper discusses the publicity of the professional title review behavior,and the inequality between the applicant and the subject of the review in the process of professional title review and demonstrates that the professional title review behavior of higher vocational schools belongs to an administrative behavior,which should be subject to the principles of administrative law and related rules.
