摘要
《关于办理电信网络诈骗等刑事案件适用法律若干问题的意见(二)》针对当前打击电信网络诈骗犯罪工作中存在的新的突出问题,立足司法实践,对电信网络诈骗及其关联犯罪,特别是涉“两卡”犯罪,提出了更加明确具体的法律适用标准。本文阐述了该意见的出台背景、制定原则,并重点解读了意见的主要内容,包括电信网络诈骗及其关联犯罪案件的管辖、跨境电信网络诈骗犯罪的认定、非法交易“两卡”犯罪的认定、异地办案的取证、宽严相济刑事政策的贯彻、追赃挽损的要求等。本文认为,《意见二》不是对《意见一》的修订,而是对《意见一》的补充,二者是承继性关系,相辅相成,均为办理电信网络诈骗及其关联犯罪案件的主要法律依据。
“Opinions on Several Issues Concerning the Application of Law in the Handling of Telecommunications and Network Fraud and Other Criminal Cases(Ⅱ)”aims at the new and prominent problems in the current work of combating telecommunications and network fraud crimes,based on judicial practice,and provides a comprehensive review of telecommunications and network fraud and its related crimes,especially for crimes involving“two cards”,for which more specific legal application standards have been put forward.This article introduces the background and formulation principles of the Opinions,and focuses on the interpretation of the main contents of the Opinions,including the jurisdiction of telecommunications network fraud and its related crimes,the determination of cross-border telecommunications network fraud crimes,and the determination of illegal transaction“two cards”crimes,evidence collection for cases handled in diff erent places,implementation of criminal policies,requirements for recovering stolen goods and recovering damages,etc.“Opinion(Ⅱ)”is not an amendment to“Opinion Ⅰ”,but a supplement to“Opinion Ⅰ”.The two are in an inherited relationship and complement each other,and both are the main legal basis for handling telecommunications network fraud and related crime cases.
