摘要
中华法系历经二千多年的发展与积淀,形成了独特的法律文化和精湛的法律解释技法,其中立法文义解释在官方法律解释中长期居于主导地位。从对文义解释的不同运用方式看,可以区分为以下几个方面的操作机制:对于重要法律用语一般是直接在疏议中给出权威确定的解释;通过串解的方式对具有关联关系的律文和重要概念一并作出解释;通过援引或假定具体案件案情的方式对文义解释作出示例;对重要语词含义作出训诂解释;通过援引令格式、儒家义理或社会公理等权威性依据释明概念或律文含义。在中华法系立法文义解释过程中,遵循“通常含义”“余条准此”“释不破律”等方面的解释规则,将法律解释置于法的目的之下。中华法系博大精深、富蕴宝藏,当下中国法治建设应在整理、选择、汲取、融通包括法律解释方法在内的中华法系和世界制度文明史上的一切优秀知识资源基础上,付诸实用,必将极大地有利于中国特色社会主义法治体系建设的顺利推进和法治中国建设目标的达成。
The Chinese legal system has developed its own unique culture and methods for legal interpretation in its over two thousand years'development.Literal interpretation has been the dominant one in the legislator's interpretation of laws.Specifically,from the different applied ways,literal interpretations are often made in several mechanisms:to directly give the authoritative interpretations on the important legal expressions in the commentaries and annotations;to make interpretations on the legal concepts of the inter-connected provisions by means of serialization;to make exegetic explanation of the meaning of important words to give examples by making references or making scenarios;to explain the legal concepts or provisions by citing the statutes,regulations and ordinances,Confucian theories or social customs and other authoritative references.In the Chinese legal system,the legislative interpretation often adopts the methods of"general meaning","other articles complying with this one"and"an interpretation never exceeding the limits of law",and puts itself under the scope of the purpose of law.Given the profound Chinese legal system,the rule of law construction ongoing in China should organize,select,absorb and integrate all the excellent resources of Chinese legal system and other legal civilizations including the methods of interpretation and put them into practice for quickly and smoothly advancing the rule of law system with Chinese characteristics and make China a law-based country.
