摘要
我国老年教育法律法规暂未成体系,当前施行的地方法规主要以天津市、山东省、安徽省和徐州市四地颁布的老年教育条例为代表。通过对这四部地方立法进行比较分析,发现了我国老年教育立法存在的问题。我国老年教育地方立法存在立法理念落后、管理体制设计未突破、法律责任规定不明确等问题,这些问题也是我国老年教育立法发展的障碍。建议加强老年教育理论研究,更新立法理念;推动国家立法,明确老年教育的管理体制;出台政策、配套措施,补强地方条例的可操作性,从而推动老年教育立法,有效应对人口老龄化带来的社会问题。
China’s laws and regulations on education for the elderly have not yet formed a system.The curcent local laws and regulations mainly include those issued by Tianjin,Shandong province,Anhui province and Xuzhou city.Through the comparative analysis of these four local legislations,it is found that there are some problems in the legislation of elderly education in China:backward legislative concept,unbroken management system design and unclear legal liability provisions,which are also obstacles to the development of elderly education legislation in China.It is suggested to strengthen the theoretical research of elderly education and update the legislative concept,promote national legislation to clarify the management system of elderly education,and introduce policies and supporting measures to complement the operability of local regulations,so as to promote the development of elderly education legislation,and effectively respond to the social problems brought by the aging population.
