摘要
“冰墩墩”知识产权侵权案引发业界对陶瓷文创产业知识产权管理保护的关注。从知识溢出效应、知识产权保护强度与产业的创新能力“倒U型”关系,得出有力的知识产权管理保护有利于扩大陶瓷文创产业的集聚效应,合适的知识产权法律体系有利于优化陶瓷文创产业的市场环境,恰当的知识产权政策有利于促进陶瓷文创产业的创新等结论。同时依据景德镇陶瓷文创产业的发展现状梳理出陶瓷文创产业发展中知识产权管理保护存在的问题,进而提出合理的对策与建议。
The intellectual property(IP)infringement case of Bing Dwen Dwen has captured the attention of the industry to IP management and protection of the ceramic cultural and creative industry.In this paper,by analyzing the knowledge spillover effect and the inverted U-shaped relationship between the IP protection intensity and industrial innovation capability,it can be concluded that the strong IP management and protection is beneficial to magnifying the combined effect of the ceramic culture and creative industry,a suitable IP legal system is beneficial to optimizing the market environment of the industry,and reasonable IP policies are beneficial to boosting innovation in the industry.Based on the current development situation of the ceramic cultural and creative industry in Jingdezhen,the problems concerning IP management and protection in the development of the industry are sorted out,and then reasonable solutions and suggestions are put forward.
