摘要
案例指导制度作为我国一项重要的司法制度,在弥补立法和司法解释滞后、确保法律统一正确实施及规范司法办案等方面发挥着愈加重要的作用。基于检察指导性案例“活力”不足,效能未充分释放、基层检察机关案例在检察指导性案例统计中比例持续上升等现状和特点,有必要以基层检察工作的视角,系统梳理分析检察指导性案例的形成和参照适用现状及面临困境,探索并提出加强形成和参照适用检察指导性案例的优化路径,促进实现其在司法实践中发挥预期的指导作用。
As an important judicial system in China,the case guidance system plays an increasingly important role in making up for the lag in legislation and judicial interpretation,ensuring the uniform and correct implementation of laws,and standardizing judicial case handling.Based on the current situation and characteristics of insufficient“vitality”of procuratorial guiding cases,insufficient release of effectiveness,and continuous increase in the proportion of cases of grassroots procuratorial organs in the statistics of procuratorial guiding cases,it is necessary to systematically sort out and analyze the current situation and difficulties faced by the formation and reference application of procuratorial guiding cases,explore optimized paths for strengthening the formation and application of procuratorial guiding cases and promote the realization of its expected guiding role in judicial practice from the perspective of grassroots procuratorial work.
