摘要
高危险性体育项目经营活动监管中的国家标准适用应当贯穿行政许可、监督检查和行政处罚的全过程。体育主管部门在实践中对于如何获取体育设施符合国家标准的证明内容,存在对标准理解不一致和适用不到位的困境。通过对法律、法规的解读和逻辑分析,国家标准的适用应当成为重要的技术支撑和认定依据。研究认为,行政许可阶段申请人需提交符合审批条件的证明材料,体育主管部门除对申请人提交的申请材料进行形式审查外,还需对体育场所进行实地核查。在监督检查阶段,检查内容应当覆盖审批条件和国家标准的全部内容。对于高危险性体育项目经营活动监管,我国应当构建第三方合格评定机制,强化专业技术支持,提高监管效能,降低监管风险。
The application of national standards in the supervision of business activities of high-risk sports should run through the whole process of administrative licensing, supervision and inspection, as well as administrative punishment. In terms of the way for sports authorities to obtain the proof that sports facilities meet national standards in practice, there is a dilemma of different understanding and inadequate application of standards. The interpretation and logical analysis of laws and regulations show that the application of national standards should become a critical technical support and identification basis. According to the research, applicants need to submit the certification materials that meet the examination and approval conditions in the administrative licensing stage. Apart from the formal examination of the application materials submitted by the applicants, the sports authorities also need to conduct on-the-spot verification of the sports venues. In the stage of supervision and inspection, the inspection contents shall cover the examination and approval conditions and all national standards. For the management and supervision of high-risk sports projects, a third party qualification assessment mechanism should be built to strengthen professional technical support, enhance the supervision efficiency and lower the supervision risk.
