摘要
乡村集体土地产权转换为国有土地产权,是刺激资本下乡推动乡村发展的重要手段之一。乡村集体土地产权转换意味着乡村治理格局发生转变,研究从关系产权理论视角出发,构建了“产权—主体”分析框架,通过对江西省婺源县篁岭村乡村集体土地产权转换的全过程研究,揭示乡村集体土地产权转换中包含的政府、企业、村民之间的关系产权运作逻辑。研究发现,在乡村集体土地产权转换中,市场化运作虽然能够保证企业运行的高效率,但是村民主体存在“脱嵌”风险,乡土传统文化面临难以传承的现实问题,因此需要谨慎推动乡村集体土地产权转换,在维持乡村集体土地产权的基础上创新乡村治理模式。
The conversion of rural collective land property rights to state-owned land property rights is one of the important means to stimulate capital flow to the countryside for rural development.The transformation of collective land property rights implies the transformation of the rural governance pattern.From the perspective of relational property rights theory,the article constructs a "property-subject" analysis framework.Through a typical case study of the entire process of rural collective land property rights conversion in Huangling Village,Wuyuan County,Jiangxi,it reveals the operational logic among government,enterprises,and enterprises involved in the conversion of land property rights.Although market-oriented operation can ensure the high efficiency of enterprise operation,village democracies face the risk of detachment,and traditional rural culture is facing difficulty of preservation.Therefore,it is necessary to cautiously promote the conversion of land property rights and innovate rural governance models on the basis of maintaining collective land property rights.
