摘要
当前我国科技伦理治理存在诸多问题,难以适应科技创新发展需要。生物医学伦理作为科技伦理的重要组成部分,为加强生物医学领域治理,生物医学伦理的法治化是必由之路。现阶段生物医学伦理法治化的社会基础已经成熟,现实中不断发生的违法案件也对该领域的规制提出了要求。目前我国生物医学伦理立法体系混乱、结构单一,伦理委员会伦理审查流于形式,应当健全生物医学领域立法,强化生物医学领域治理体系,完善生物医学领域监督管理体系,以解决生物医学领域伦理治理的问题。
At present,there are many problems in the ethical governance of science and technology in China,and it is difficult to meet the needs of scientific and technological innovation. As an important part of scientific and technological ethics,biomedical ethics is the only way to strengthen the governance of biomedical ethics. At this stage,the social foundation of the legalization of biomedical ethics is mature,and the continuous illegal cases in reality also put forward requirements for the regulation of this field. At present,China’s biomedical ethics legislation system is chaotic and simple,and the ethics review of the ethics committee is in a formality. It is necessary to improve the legislation in the field of biomedicine,strengthen the governance system in the biomedical field,and improve the supervision and management system in the field of biomedicine,so as to solve the problem of ethical governance in the biomedical field.
