摘要
当下小区私人车位安装充电桩困难重重,除实际安装条件受限外,最大的阻力源自物业公司。在符合安装条件下,物业公司拒不配合业主安装私人车位充电桩构成对物业服务合同的违约,同时也违背了《民法典》的绿色原则,其中可能的原因是物业公司服务与管理职能的定位偏差,绿色原则中“资源”的理解分歧以及司法实践中安全保障义务的边界模糊,应当明确物业公司服务与管理的职能定位,界定绿色原则“资源”的范围,厘清安全保障义务的边界,用法律手段缓解业主与物业公司之间的矛盾,打通私人车位充电桩进驻小区的最后一关。
The installation of charging piles in private parking spaces in the community is difficult at present.In addition to the actual installation conditions,the biggest resistance originates from property companies.The refusal of property companies to cooperate with owners to install charging piles in private parking spaces under the installation conditions constitutes a breach of contract of the property service contract,and also violates the Green Principle of the Civil Code.It should clarify the positioning of the service and management functions of property companies,define the scope of the"resources"of the green principle,clarify the boundary of the safety and security obligations,alleviate the contradictions between property owners and property companies by legal means,and break the last barrier of private charging piles in the community.
