摘要
信息时代为我们带来便利的同时也使得犯罪行为越来越具有隐秘性,互联网技术的发展使得性犯罪不再局限于传统的接触型犯罪。“报复色情”“线上猥亵”“儿童色情制品”等新型性犯罪形式层出不穷。美国、英国等国家有针对性以专门立法的形式惩罚“报复色情”型网络犯罪,加拿大就非法制作、传播、获取和持有“儿童色情制品”的行为予以了刑法规制,并建立了完备且健全的儿童色情强制报告制度。同时为避免网络性犯罪,各国通过立法加强对互联网的监管。以域外国家规制和打击信息化时代性犯罪的有效经验为借鉴,在刑事立法上要适应时代的发展和变化,加强互联网管制,结合本土国情进行多方面的制度完善,才能更好地遏制信息化时代性犯罪的发生和增长。
Information age brings us convenience,but also makes criminal behavior more and more difficult to detect.The development of Internet technology makes sexual crime not be limited to traditional contact crime.New forms of crime,such as revenge porn,online obscenity and child pornography,have emerged.The"revenge porn"online crimes in the form of special legislation have been targeted and punished in the USA,the UK and other overseas countries.Behaviors in Canada,such as illegal production,dissemination,acquisition and possession of"child pornography",have been regulated by criminal laws,and a complete and detailed mandatory reporting system for child pornography has been established.At the same time,in order to avoid online sexual crimes,countries have strengthened the supervision of the Internet.Therefore,it is necessary to learn lessons from the effective experience of foreign countries in regulating and cracking down on information crimes,so as to adapt to the development and change of the times in criminal legislation.Internet control should be strengthened as well.Only in this way can our country better curb the occurrence and growth of information age crimes.
