摘要
农作物种子质量标准涉及种子自身特性,如熟性或生育期长短、高产丰产性、抗病虫性、抗逆性等,还涉及种子的商品性,品质良好的优质种子主要是针对种子检验的质量概念而言的。特别是品种的真实性与一致性。这些特点对不同的产业部门,如生产者、加工者、经营者、应用者、种子管理部门都是非常关键的判断和评判要素,农作物种子纠纷问题屡见不鲜,形成纠纷的原因多种多样。无论是农作物种子自身的因素,还是其他因素影响,种子质量问题造成的问题往往影响生产者收成,出现的纠纷问题也有延后性,导致当季收成受到影响,还危及来年的粮食安全,不利于农村稳定发展,如若解决不当,容易引起群体性事件。本研究试图客观分析农作物种子质量标准、种子质量纠纷的形成原因,准确划分法律责任,为避免种子质量纠纷的发生、发展提出解决方案。
The quality standards of crop seeds involve their own characteristics,such as maturity or length of growth period,high yield,disease and insect resistance,stress resistance,etc.,and also involve the commercialization of seeds.High quality seeds with good quality are mainly aimed at the quality concept of seed inspection.Especially the authenticity and consistency of varieties.These characteristics are very critical judgment and evaluation elements for different industrial departments,such as producers,processors,operators,users and seed management departments.Crop seed disputes are common,and the causes of disputes are various.Whether it is the factors of crop seeds themselves or other factors,the problems caused by seed quality problems often affect the harvests of producers,and the disputes that arise are also delayed,which will affect the harvests of the current season,endanger the food security of the next year,and is not conducive to the stable development of rural areas.If they are not solved properly,it is easy to cause mass incidents.This study attempts to objectively analyze the causes of crop seed quality standards and seed quality disputes,accurately divide legal responsibilities,and propose solutions to avoid the occurrence and development of seed quality disputes.
