摘要
“人民司法”是中国特色社会主义法治话语的典型表达。在中国共产党领导的法治现代化进程中,经历革命话语、改革话语和强国话语的历史考验,“人民司法”话语内涵得以确证,具体表现为马克思主义法学理论是其理论源头、扎根中国大地是其实践特质、中华法系优秀文化传统是其文化基因和不断与时俱进是其生命特质。“人民司法”话语的形成,体现了原创性和科学性统一、人民性和实践性统一、民族性和时代性统一的结构表达。“人民司法”蕴含了党对司法全面领导的政治逻辑、司法保障人民当家作主的理论逻辑、司法践行群众路线的实践逻辑、司法维护公平正义的本体逻辑和司法服务工作大局的治理逻辑等基本规律,成为推动中华民族伟大复兴的法治利器。
“People’s justice”is a typical expression of the discourse of socialist rule of law with Chinese characteristics.Under the leadership of CPC,the modernization of rule of law has experienced the historical test of revolutionary discourse,reform discourse and great country discourse.The connotation of“people’s justice”has been proved that Marxist law theory is its theoretical origin,rooting in China is its practical trait,Chinese excellent law culture is its cultural gene,and keeping with the time is its living feature.The formation of the discourse reflects the structural expression of the unity of originality and science,the unity of people and practice,and the unity of ethnicity and the times.“People’s justice”possess the political logic of the Party’comprehensive leadership of justice,the theoretical logic of judicial safeguard for people’s self-determination,the practice logic of the mass judicial practice,the ontology logic of the maintenance of justice and the governance logic of the legal service for the overall situation.It has become a sharp weapon for the rule of law to promote the great rejuvenation of the Chinese nation.
