摘要
在“放管服”改革背景下,政府审批职能下放在激发市场活力的同时,增加了对于事中事后监管的需求,传统的监管方式难以应对新时代的监管需求,自我规制可能成为潜在的加强事中事后监管能力建设的重要路径和手段。但是自我规制本身也存在多样性,政府如何能够巧妙引入自我规制并使其能够长期运行是成功运用这一工具的微妙之处。文章介绍了自我规制兴起的背景和在中国的实践,并着重以化工行业自我规制“责任关怀”体系为例,分析其实施成效和实施机制,提出当前实践中的不足,并提出相应的改革建议和举措。在此基础上归纳了政府部门恰当推动自我规制的一般理论和启示意义。
In the process of China’s administrative reform,the decentralization of the approval function not only vitalizes of the market dynamics,but also increases the demand of concurrent and ex post supervision.The traditional regulatory approach struggles to meet the regulatory need in the new era,prompting a surge in demand of self-regulation as a means to emphasize the concurrent and ex post supervision.This paper takes the analysis of the development and practice of self-regulation in China,particularly focuses on Responsible Care,a voluntary environmental regulation practices in the chemical industry.The authors have examined the effectiveness and mechanism of self-regulation and put forward a couple of reform recommendations and measures.
