摘要
新制定的《广东省乡村振兴促进条例》共设8章60条,根据国家乡村振兴促进法的原则规定,结合广东省情暨乡村振兴促进工作需要,主要从产业发展、乡村人居环境提升、乡村治理、城乡融合发展、促进共同富裕的帮扶机制、保障措施等方面作出实施性规制。该条例体例架构精干适中,跟国家上位法及其他省市同类立法相比,特色明显,亮点诸多;其重在追求立法内容的精准对标——即在城乡融合、特色产业发展、乡村治理、基础设施建设、岭南文化保护等方面精准把握调整重点,在调整功能上凸显对上位法的补充性与实施性,更是针对本省域乡村振兴促进工作要解决的突出问题进行创制规范或指引,强调“务实”和“管用”,统筹推进全省“五大振兴”、城乡融合发展,完善制度保障体系,体现广东改革发展特点暨乡村振兴法治实践需求。
The newly formulated regulations on the promotion of Rural Revitalization in Guangdong Province has a total of 8 chapters and 60 articles.According to the principles and provisions of the National Rural Revitalization promotion law,combined with the situation of Guangdong Province and the needs of Rural Revitalization promotion work,the implementation regulations are mainly made from the aspects of industrial development,rural residential environment improvement,rural governance,urban-rural integration and development,assistance mechanisms to promote common prosperity,safeguard measures,etc.The structure of the regulation is lean and moderate.Compared with the national superior law and similar legislation in other provinces and cities,it has obvious characteristics and many highlights;It focuses on the pursuit of accurate benchmarking of legislative content-that is,accurately grasp the adjustment focus in terms of urban-rural integration,development of characteristic industries,rural governance,infrastructure construction,Lingnan cultural protection,etc.,highlight the complementarity and implementation of the superior law in the adjustment function,and create norms or guidelines for the outstanding problems to be solved in the promotion of Rural Revitalization in the province,emphasizing"pragmatic"and"effective",Comprehensively promote the"five revitalization"of the province,the integrated development of urban and rural areas,improve the institutional security system,and reflect the characteristics of Guangdong's reform and development and the practical needs of Rural Revitalization of the rule of law.
