摘要
饭圈失范是粉丝经济乱象的表象,具体表现为“控评”“撕黑”、滥用举报、诱导消费、过度消费、数据造假与账目造假等,实质是资本追逐经济利益的失控。“唯流量论”的市场价值判断标准造成娱乐文化产业的异变与畸形,也逐渐渗透到政治与社会事件等公共领域,更是裹挟着互联网用户参与到非理性的群体性行动之中。饭圈失范反映了新业态法律规制有效性的严重不足,对于互联网新业态中的违法违规行为,政府应以监管者身份积极实施微观规制,依法依规对数字经济新业态进行适度限制。规范粉丝经济的交易秩序,需要引导与监管“双管齐下”,多方治理主体共同参与,提升用户自律、引导行业自律、加强网络平台的监管责任、提高政府的网络治理能力。
The fandom anomie is the appearance of chaos of fans economy,which is specifically manifested in controlling comments,striking back anti-fans,abusing reporting,inducing consumption,excessive consumption and fake data and accounts.In essence,it is the uncontrolled pursuit of economic interests by capital.The commercial value judgment standard of“excessive focus on clout”has caused changes and deformities of the entertainment and culture industry,and has gradually penetrated into the public fields such as political and social events.It also coerces Internet users to participate in irrational group actions.The anomie of the fandom reflects the serious lack of the effectiveness of the legal regulation of the new economic form.For the illegal acts in the new business form of the Internet,the law should actively implement micro regulation as a regulator.To standardize the trading order of fan economy,we need to resort to guidance and supervision simultaneously as a two-pronged approach,with the joint participation of multiple governance subjects,improve user self-discipline,guide industry self-discipline,strengthen the regulatory responsibility of network platform,and improve the government’s network governance ability.
