摘要
口供治理之殇主要源于侦查权制衡的缺失。法律规则上,单纯凭借“印证模式”的证据审查方式无法鉴别侦查证据的合法性,导致了以非法侦讯为手段进行口供获取的问题难以从根源上治理。籍此,在司法与科技不断融合的当下,可以运用区块链技术所蕴含的去中心化、分布式记账、不可篡改性等特征原理,依托私有链与联盟链等链间互动操作的方式,重塑电子卷宗保管和证据链构建,进行侦讯口供治理和取证流程监管。进而防止非法取证、证据隐匿和流失等违规侦讯行为的发生,推动侦讯和口供治理机制的创新。
The problem of confession governance mainly stems from the lack of checks and balances of investigative power.In terms of legal rules,the legitimacy of investigation evidence can not be identified simply by relying on the evidence review method of"confirmation mode".As a result,it is difficult to solve the problem of obtaining confessions by means of illegal investigation.Therefore,with the continuous integration of justice and science and technology,we can use the characteristics and principles of decentralization,distributed bookkeeping and non tamperability contained in blockchain technology,and rely on the interactive operation between private chain and alliance chain to reshape the structure of electronic file custody and evidence chain,and carry out the governance of interrogation confession and the supervision of evidence collection process.In order to prevent illegal evidence collection,evidence concealment and loss and other illegal investigation behaviors,and promote the innovation of investigation and confession governance mechanism.
