摘要
高校学术治理权作为内生于大学学术心脏地带具有契约指向的学术自治公权力,本质上属于大学自治范畴,其合理性与合法性根源于宪法保护的学术自由。行使高校学术治理权需要在学术自由的秩序空间内,基于行政法的基本规范以及学术民主胜任的价值规则,坚守有限的行政权力介入与尊让学术裁量、有限的程序正当与学术实质正义优位兼顾、有限的司法审查与学术自治监督并重的共同底线。在学术自治与学术法治的共生博弈过程中,高校学术治理权的行使既需要根植于大学学术发展内在逻辑的学术自治规制,又需要来自公法秩序的互动规制,在恪守大学内部治理自治正当与合意表达的前提下,形成大学与社会、国家之间互动合作的善治愿景。
As a contract-oriented public power of academic autonomy born in the academic heart of universities, the academic governance right of universities belongs to the category of university autonomy in essence, and its rationality and legitimacy are rooted in the academic freedom protected by the Constitution. The exercise of academic governance power in universities needs to be task-oriented to achieve academic freedom, based on the basic norms of administrative law and the value rules of academic democratic competence, adhere to limited administrative intervention and respect for academic discretion, limited procedural justice, and academic substantive justice, limited supervision over the judicial review and academic autonomy and bottom line. In the process of the symbiosis game between academic good governance and academic rule of law, the exercise of academic governance power in universities requires both academic autonomy regulation rooted in the internal logic of academic development of the university, as well as interactive regulation from the public law order. In abiding by the proper and consistent governance of the university under the premise of expression, a vision of good governance of interaction and cooperation between universities,society and the country are formed.
