摘要
2019年以来,危险驾驶罪成为个罪案件数最多的罪名,该罪是否导致“过罪化”的问题是晚近刑法界热议所在。该罪作为典型的预防型犯罪,其前瞻性的风险预防范式旨在阻断行为危险性向结果危险性转化的因果流程,但其独特的归责范式也潜藏着虚化构成要件、不当延展刑法触手的法治危机。犯罪是事实与价值交织的行为,“严重的社会危害性”是新康德主义价值哲学视域下对犯罪本质的揭示,危险驾驶罪也应契合犯罪本质的内在要求。危险驾驶罪的出罪存在理论和实务上的困境,根源在于形式解释导致入罪标准过低。刑法的谦抑包括立法的谦抑和司法的谦抑,在刑事法网日益严密、法定犯不断增加的当下,需借助功能主义基础上的刑法实质解释方法,着力通过司法之实质评价建构该罪的出罪机制,实现刑法谦抑。
Since 2019,the crime of dangerous driving has been breeding the largest number of criminal cases.Whether this crime is“overcriminalized”is a hot topic of the criminal law field in recent years.As a typical preventive crime,its perspective risk prevention paradigm aims to block the causal process of the transformation from a behavioral risk to a result risk.However,its unique imputation paradigm also conceals the crisis of rule of law of emptying tatbestand and improperly extending the application scope of the criminal law.Crime is a behavior intertwined with facts and values.“Serious hazard to society”is the revelation of the essence of crime from the perspective of Neo-Kantianism value philosophy.The crime of dangerous driving should also hfit the internal requirement of criminal essence.The theoretical and practical difficulties in the crime of dangerous driving are rooted in the low standard of criminalization caused by formal interpretation.The modesty of criminal law includes the modesty of legislation and the modesty of judicature.At present,with the increasingly strict criminal law and the increasing number of mala prohibita,it is necessary to use the essential interpretation method of criminal law based on functionalism to focus on constructing the decriminalization mechanism of this crime through essential evaluation of judicature so as to realize the modesty of criminal law.
