摘要
在司法实践中,关于农村房屋抵押合同的效力问题一直存在着有效与无效之争。法院基于“房地一体”原则,常常认定农村房屋抵押合同无效。虽然法院的认定没有违背农村宅基地使用权不得抵押的法律规定,但与目前适度放活宅基地和农民房屋使用权的政策目标相差甚远。在目前的法律框架下,“房地一体”原则有其规范的适用范围,不宜盲目适用于农村房屋抵押合同。在符合政策原则的条件下贯彻农村房屋与宅基地处分相分离的原则,承认农村房屋抵押合同有效,可以充分发挥农村宅基地和房屋的经济价值,促进新农村建设。
In judicial practice,there has always been a dispute over the validity and invalidity of the rural house mortgage contract.Based on the principle of“integration of housing and land”,courts often determine that rural housing mortgage contracts are invalid.Although the court’s determination does not violate the legal provisions that the right to use rural homesteads cannot be mortgaged,it is far from the current policy goal of moderately releasing the right to use homesteads and farmers’houses.Under the current legal framework,the principle of“integration of housing and land”has its normative scope of application,and should not be blindly applied to rural housing mortgage contracts.Implementing the principle of separation of rural housing and homestead disposal under the conditions in line with the policy principles,and acknowledging the validity of the rural housing mortgage contract,can give full play to the economic value of rural homesteads and houses,and promote the construction of new rural areas.
